Drive Participation Waiver & Liability Release

Organiser: 4WD AUTHORITY L.L.C-FZ, Meydan Free Zone, Dubai, UAE (Licence 2650515.01)

By registering for any drive event organised by 4WD AUTHORITY L.L.C-FZ (the "Organiser"), you (the "Participant") confirm that you have read, understood and agree to these terms in full.

1. Nature of Activity

Off-road and desert driving involves inherent risks including uneven terrain, remote locations, extreme weather, mechanical failure, and other unpredictable hazards. The Organiser facilitates group drives as an organiser only and provides no supervision, instruction, or safety guarantee of any kind.

2. Assumption of Risk

The Participant voluntarily assumes all risks associated with the drive, including death, serious bodily injury, permanent disability, and loss or damage to property - regardless of cause, including any negligence by the Organiser, its representatives, marshals, or other participants.

3. Passengers

Any passenger in the Participant's vehicle travels entirely at the Participant's own risk and responsibility. The Organiser bears no liability whatsoever for injury, death, or loss suffered by any passenger. The Participant fully indemnifies the Organiser against all claims arising from any harm to passengers in their vehicle.

4. Third-Party Liability

Any damage to, injury to, or death of any third party arising from the Participant's conduct during a drive event is the Participant's sole legal and financial responsibility. The Organiser accepts no liability for any third-party claims of any nature.

5. Property & Vehicle Damage

The Participant accepts full responsibility for any damage to their vehicle, equipment, or personal property during a drive event, including damage occurring during recovery operations performed at the Participant's request.

6. Role of the Organiser

4WD AUTHORITY L.L.C-FZ acts solely as an organiser of group drive events. Marshals assist with route coordination only and do not assume any duty of care towards participants.

7. Competency

The Participant warrants that they possess the necessary skill, experience and knowledge to operate their vehicle safely in the terrain specified. The Organiser does not assess or verify participant competency. It is the Participant's sole responsibility to determine whether they are capable of participating safely.

8. Vehicle Condition

The Participant warrants their vehicle is in a roadworthy, mechanically sound condition appropriate for off-road use, with all safety equipment - including headlights, fog lights, recovery gear and valid insurance - in working order.

9. Full Indemnity & Release

The Participant fully and irrevocably indemnifies, releases and holds harmless 4WD AUTHORITY L.L.C-FZ, its officers, employees, agents, marshals and representatives from and against any and all claims, actions, damages, costs, losses and liabilities of any nature - whether in contract, tort, statute or otherwise - arising from or relating to the Participant's participation in any drive event, including claims arising from the death, injury or disability of the Participant, any passenger, or any third party, and any damage to material property or third-party vehicles.

10. Governing Law

This waiver is governed by the laws of the United Arab Emirates. Any dispute arising from this waiver shall be subject to the exclusive jurisdiction of UAE courts.

By accepting this waiver during drive registration, you confirm you have read, understood and agree to be legally bound by all terms above.
